This calculation is based on the current tax assessment of the town at the time of the change of use and prorated under a formula known as Common Level Assessment (CLA). Ms. Hunt of the Current Use Program has identified for me that the recapture penalty of the CLA is prorated at 10 to 20 percent based on years in the program of more than 10 years and top level ceiling of 20 years.

So tax stabilization is what this seems to be all about to offset the future penalty. What a gift 80 percent property tax free for 20 years or more and just a 10 to 20 percent penalty when use is changed, i.e., development.
